Notice is hereby given that the Essex County Council proposes to make the above Order under Sections 1(1), 2(1) to (3), 3(2), 4(1), 4(2), 32(1), 35(1), 45, 46, 49, 53 and Parts III and IV of Schedule 9 of the Road Traffic Regulation Act 1984.

Effect of the order:

  1. To Upgrade the existing advisory bays to enforceable ‘Disabled Badge Holders Only Bay’ parking restriction on the following roads in the District of Tendring as specified:
Road Description
Page Road, Clacton-On-Sea SOUTH SIDE ONLY: From the boundary of No’s 23 and 25 Page Road, eastwards for a distance of approximately 6.5 metres

  1. To Revoke ‘Disabled Badge Holders Only Mon-Sat 8am-6pm 3hrs No Return Within 2hrs parking restriction on the following roads in the District of Tendring as specified:
Road Description
Brook Street, Manningtree WEST SIDE ONLY: From opposite a point approximately 15.5 metres South of its junction with Stour Street southwards for approximately 6.6 metres

  1. To Revoke ‘Disabled Badge Holders Only Bay’ parking restriction on the following roads in the District of Tendring as specified:
Road Description
Foster Road, Parkeston NORTH WEST SIDE ONLY: From the eastern boundary wall of No 2 Foster Road South-West for a distance of approximately 6.6 metres.

Fernlea Road, Harwich WEST SIDE ONLY: From the southern boundary of No 38 North-East for a distance of approximately 6 metres

  1. To Revoke, ‘Disabled Badge Holders Only Bay’ and Implement ‘Residents Permit Holders Only’ parking restriction on the following roads in the District

of Tendring as specified.

Road Description
Meredith Road, Clacton-On-Sea SOUTH SIDE ONLY: From a point approximately 1 metre west of the common boundary of No’s 19 and 21 Meredith Road, East for a distance of approximately 5.0 metres.

This Order will be incorporated into The Essex County Council (Tendring District) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) Consolidation Order 2019 by substituting map tiles: TM230 322, TM255 320 Revision 0 to Revision 1, TM170 150, TM105 317, TM170 152 Revision 1 to Revision 2.

 Statement of Reasons

 Installation of a Disabled Parking Bay:

Essex County Council is aware that some Essex residents require a Disabled Parking Bay marked on the Highway outside of their home in order to help reduce the distance they need to travel between their home and their vehicle.

Essex County Council will consider providing such bays for residents with a valid Blue Badge and a vehicle registered to the property. The bays proposed in this order are required for residents who meet this criteria.

Although Disabled Parking Bays are installed for specific individuals, any Badge Holder may benefit from them.

Removal of a Disabled Parking Bay:

Disabled Parking Bays are installed in primarily residential areas for specific individuals, however any Badge Holder may benefit from them. Once we have been notified that the original applicant no longer needs the Disabled Parking Bay, redundant bays are removed in order to return the space to the Highway enabling any vehicle to park there or to reintroduce the original parking restrictions located on that particular road, prior to the installation of the bay.

Upgrade of Advisory Disabled Parking Bay:

In the first instance, Essex County Council will provide the applicant with an advisory Disabled Parking Bay. If the bay is continually being used by other road users without showing a valid Blue Badge then the Council will consider making a Traffic Regulation Order to make the restriction legally enforceable, to prevent unauthorised parking.

The Essex County Council in exercise of its powers under Sections 1(1), 2(1) to (3), 3(2), 4(1), 4(2), 32(1), 35(1), 45, 46, 49, 53 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (“the Act”) and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the Act, hereby make the following Order:-

 

  1. This order shall come into operation on 20** and may be cited as The Essex County Council (Tendring District) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) (Amendment No.12) Order 20**
  2. This Order will be incorporated into The Essex County Council (Tendring District) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) Consolidation Order 2019 by substituting map tiles: TM230 322, TM255 320 Revision 0 to Revision 1, TM170 150, TM105 317, TM170 152 Revision 1 to Revision 2.
